Transfer to or from a domestic partner

Do I need to let you know if I want to transfer my vehicle?

If you're transferring a vehicle to your current or former husband, wife or domestic partner, you'll need to notify us within 14 days of the transfer.

A person is in a domestic relationship with someone if they:

  • are in a de facto relationship
  • are in a registered relationship 

How do I transfer my vehicle?

If you are transferring a vehicle to a spouse or domestic partner, you’ll need to visit a VicRoads Customer Service Centre and bring with you:

 

If you’re transferring to a current spouse or domestic partner, you’ll also need either:

  • an original or certified copy of your marriage certificate, or
  • your relationship certificate (from the Births, Deaths and Marriages or City of Melbourne), or
  • a Statutory declaration (PDF) completed by both parties declaring the relationship.

 

If you’re transferring to/from a former spouse or domestic partner, you’ll also need either:

  • a copy of the Family Court Order, which must include the court order number and the details of the vehicle, or
  • a mediation agreement or binding financial agreement, signed by both parties, and endorsed by a court, Community Mediation Centre or a solicitor. The agreement must nominate which party the vehicle/s is/are to be transferred to, or
  • a Statutory declaration (PDF) from both parties, confirming that they were married or domestic partners in a bona fide domestic relationship and agreeing to the transfer. The declaration must nominate which party the vehicle/s is/are to be transferred to.

 

You won’t need to:

  • provide a roadworthy certificate
  • pay motor vehicle duty fees.
